1. ACCEPTANCE OF TERMS

By accessing, downloading, or using the ReadHim mobile application, website, or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. These Terms constitute a legally binding agreement between you and Aura Creative LLC ("Company," "we," "us," or "our").

2. DISCLAIMER OF LIABILITY AND ASSUMPTION OF RISK

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY AS IT LIMITS OUR LIABILITY TO YOU.

THE SERVICE IS PROVIDED FOR ENTERTAINMENT AND INFORMATIONAL PURPOSES ONLY. The Service uses artificial intelligence to analyze text messages and provide interpretations, suggestions, and responses. These AI-generated outputs are not professional advice and should not be relied upon as the sole basis for making decisions about relationships, personal safety, or any other important life matters.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

  • The Service does not provide professional relationship counseling, psychological advice, legal advice, or safety assessments
  • AI-generated content may be inaccurate, incomplete, or misleading
  • You are solely responsible for all decisions and actions you take based on the Service's outputs
  • The Company has no liability for any consequences arising from your use of or reliance on the Service
  • Dating and relationships involve inherent risks, including but not limited to emotional harm, physical danger, and financial loss
  • The Service cannot detect or prevent dangerous individuals or situations

BY USING THE SERVICE, YOU ASSUME ALL RISKS ASSOCIATED WITH DATING, RELATIONSHIPS, AND INTERPERSONAL INTERACTIONS, INCLUDING BUT NOT LIMITED TO RISKS OF PHYSICAL HARM, EMOTIONAL DISTRESS, STALKING, HARASSMENT, ASSAULT, FRAUD, AND OTHER CRIMINAL ACTIVITY.

3. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AURA CREATIVE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Physical injury or death
  • Emotional distress or mental anguish
  • Loss of profits, data, or business opportunities
  • Damage to reputation
  • Any losses arising from criminal acts by third parties
  • Any harm resulting from reliance on AI-generated content

This limitation applies regardless of the legal theory (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages. In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by law.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

4. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Aura Creative LLC, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or relating to:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws
  • Any content you submit, post, or transmit through the Service
  • Your interactions with other users or third parties
  • Any consequences arising from actions taken based on the Service's outputs

This indemnification obligation will survive the termination of these Terms and your use of the Service.

5. PROHIBITED USES

You agree not to use the Service to:

  • Harass, abuse, stalk, threaten, or intimidate any person
  • Defame, libel, or violate the privacy rights of others
  • Engage in or promote illegal activities
  • Create or distribute content that is harmful, offensive, or discriminatory
  • Impersonate another person or entity
  • Use outputs from the Service to manipulate, deceive, or harm others
  • Violate any applicable laws or regulations
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use automated systems or bots to access the Service

6. ARTIFICIAL INTELLIGENCE DISCLAIMER

The Service uses artificial intelligence and machine learning technologies to analyze text and generate responses. You acknowledge that:

  • AI-generated content is not created by human experts and may contain errors, biases, or inappropriate content
  • The AI cannot understand context, nuance, or complexity in the same way humans can
  • The Service does not have access to complete information about your situation
  • AI outputs should be considered as one of many factors in your decision-making process
  • We do not guarantee the accuracy, completeness, or usefulness of any AI-generated content

7. USER CONTENT AND CONDUCT

By submitting content to the Service (including text messages, screenshots, or other materials), you:

  • Grant us a worldwide, non-exclusive, royalty-free license to use, process, and analyze such content
  • Represent that you have the right to submit such content
  • Acknowledge that we may share content with third-party AI providers for processing
  • Agree not to submit content that violates any third party's rights

8. INTELLECTUAL PROPERTY

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of Aura Creative LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.

9. SUBSCRIPTION AND PAYMENT

Some features of the Service require a paid subscription. By purchasing a subscription:

  • You authorize us to charge your payment method on a recurring basis
  • You are responsible for all charges incurred
  • Subscriptions auto-renew unless cancelled
  • Refunds are provided only as required by law or app store policies

10. DISPUTE RESOLUTION

Arbitration Agreement

YOU AGREE THAT ALL DISPUTES BETWEEN YOU AND AURA CREATIVE LLC WILL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Delaware, and judgment on the award may be entered in any court having jurisdiction.

Class Action Waiver

You agree that any arbitration or legal proceedings shall be conducted only on an individual basis and not in a class, consolidated, or representative action. You expressly waive your right to file a class action or seek relief on a class basis.

11. PRIVACY

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.

12. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the Service after any modifications indicates your acceptance of the updated Terms.

13. TERMINATION

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

14. AGE RESTRICTIONS

The Service is intended for users who are at least 18 years old. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

15. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.

16. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Delaware.

17. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

18. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aura Creative LLC regarding the Service and supersede all prior agreements and understandings.

20. ACKNOWLEDGMENT

BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE. YOU FURTHER ACKNOWLEDGE THE RISKS INVOLVED IN USING AI-GENERATED CONTENT FOR RELATIONSHIP DECISIONS AND ACCEPT FULL RESPONSIBILITY FOR ANY CONSEQUENCES ARISING FROM YOUR USE OF THE SERVICE.
